Overview

Korean IT Promotion Agency (together with its subsidiaries, "KIPA" or "we") considers the protection of personal privacy to be one of our most important values. KIPA is protecting all of member’s personal information with our security policy. In addition, we will do our best to provide you with the best service.
As a condition of using the Game&game, you agree to be bound by the terms of this Policy. Additional terms and conditions which govern your use of the Game&game are contained in our User Agreement, and, as applicable, in certain other service-specific license agreements or terms of use, which you will be notified of at the time of your registration for the applicable services.

Information Collection, Storage and Use in game&game.com

We refer to information that identifies an individual as "Personal Information." In general, KIPA collects Personal Information from users of the game&game Sites in connection with access to certain online areas or services, including during (i) registration for certain online community services and tools such as Board and Game Forum; (ii) registration for special communications, such as email updates and newsletters; (iii) subscription registration; (iv) user surveys; (v) events, sweepstakes, contests or promotions; and (vi) registration for online multi- or single-player gaming, either through the site operated by KIPA (together with its subsidiaries, "game&game"), within a game publisher's site or through the game itself. Your Personal Information is stored on KIPA computer servers (or those of its service providers) located in the United States.

We may gather data about the areas of the game&game you visit or access. We do not use any of this navigational data about where you "as an individual user" go on game&game or share any of this data with third parties. However, we do use and share navigational data in aggregate, non-personal form to understand how our users as a group use the game&game.

Please keep in mind that whenever you voluntarily disclose personal information in public areas of game&game.com, such as the member home pages and message boards, your information can be viewed and possibly used by others. We advise users to be especially careful in such public areas about disclosing Personal Information, such as full name, home address, or phone number.

Below are more details about the Personal Information we, or third parties may gather from you and how we may use it.

A. Email Newsletters. Hereafter game&game.com may offer email newsletters to its registered users. We will use your email address to send you only the specific newsletter(s) that you signed up for. If you want to update your email address or stop receiving a newsletter, follow the procedures to unsubscribe at the bottom of any newsletter we send you or simply visit http://www.gamengame.com/ to update your profile.

B. Membership Information. When you register for membership on a KIPA Site, we will ask you for certain minimum required information, such as your name, birth date, gender, email address and country. We may also ask for additional information about you and your interests. We do this so we can better understand your preferences and tailor the game&game to suit you better. The more information you volunteer, the more we can tailor the game&game,com and promotions to your interests. Additionally, third-party service providers may require you to assent to their privacy party as a condition to receiving their service.
? Service Providers. We offer our members other services provided by third parties such as email and user-pages, among others. When you register for membership on game&game.com, you may be automatically registered to receive the services we offer and some of your Personal Information may be transferred from KIPA to those third-party service providers. By becoming a member, you authorize us and our third-party service providers to send you email updates and information about promotions and special offers. We take care to require that our third-party service providers only use our member's data as necessary to provide the particular service and to give you updates on that service provider's products and services.
? Game Publishers. We provide game publishers with certain hosted technology and software that enables various game related functionalities, such as online multi- or single-player gaming. If you are not already a registered user of the game&game you may be asked to provide Personal Information in connection with your use of such services. We share Personal Information with game publishers that offer such services to enable those entities to operate the services you have elected to receive. Game publishers may also use Personal Information for other business purposes, provided that such use shall be in compliance with the terms of this Policy, except that a game publisher (a) will not contact you or otherwise use or transfer your Personal Information, unless you have expressly consented. Upon giving such consent your Personal Information will be subject to the game publisher's privacy policy.
? Advertisers. KIPA may send you emails on behalf of our advertisers. If you opt to receive information from our advertisers they may use your Personal Information to send you advertisements or other notices, via email or postal mail, and it is possible that your information may be shared with others.
? Other Parties. We occasionally provide third parties with Personal Information limited only to your physical address in order to send you promotional mailings.

C. Email Updates to Members. If you so elect at registration, we may periodically send you promotional email about products or services offered by the game&game, our partners and advertisers. If you want to update your email address or stop receiving these types of promotional emails, please follow the procedures to unsubscribe at the bottom of any email we send you or simply visit http://www.gamengame.com to update your profile.
We may contact you regarding account status, changes to this Policy, our terms of services or other terms of use, to confirm your registration or for any other business reason related to your use of game&game.

D. Promotions. We may ask you for Personal Information at other times, including, but not limited to, when you enter sweepstakes, contests or promotions sponsored by KIPA or a third party. If you choose to enter sweepstakes, contests or promotions sponsored by a third party, the Personal Information you provide will be subject to the privacy policy of the third party sponsor. We encourage you to check the applicable third party policy before providing any Personal Information.

E. Surveys and User Research. KIPA conducts email and web-delivered surveys from time to time, as well as instant polls, to gather information about our users. Taking these surveys and polls is entirely optional. You have no obligation to respond to them. We share only the aggregate results of these surveys, not Personal Information, with our advertisers and partners to help them better understand our services and monitor the reach of their advertising or other offerings on our service. We also use some of the Personal Information that you provide in these surveys to help us understand your interests and to make the Game&game more useful to you.

F. Use of Cookies. On the Internet, a "cookie" is a piece of information (a file) that a Web site transfers to a user's computer for record-keeping purposes. The use of cookies is common on the Internet. The process we use to serve advertisements and to track use of the game&game involves cookies. We use cookies to recognize users who have already registered for game&game site, allowing those users to speed up their future activities on the game&game. KIPA occasionally uses web beacons on the game&game in order to count users and to recognize registered users by accessing the KIPA cookies.

G. Software Updates; Interactive Material. KIPA automatically updates software used in conjunction with certain of the services available on the game&game. In order to update this software, KIPA collects a user's current version information from the user's computer. This information is not archived and is only used to determine which software requires updating.

H. Sites You Visit. As you access our Partner Sites (Game company related our game downloads list) and browse around the game&game, KIPA may store information about which pages and which Partner Sites you visit and other information presented in your browser's URL address line. KIPA will use this information to help determine what our users are most interested in.

I. Sharing Non-Personal Information. KIPA may share information that is not Personal Information -- meaning non-personal, aggregate, or summary, information regarding our users -- with other third parties not mentioned in this Policy. This kind of information does not identify you individually.

J. Merger or Acquisition. In the event of a merger, acquisition, reorganization, sale of all or substantially all of its assets, or the sale of an individual website owned by KIPA, KIPA may transfer your Personal Information to a third party as a part of such merger, acquisition, reorganization, or sale.

K. Legal Authorities. We may also disclose Personal Information in cases when we reasonably believe that it is necessary to identify someone who may be violating KIPA policies or game&game" User Agreements or other terms of use, or who may be a threat to KIPA or third party rights, property, or personal safety. The game&game may disclose Personal Information to comply with valid legal process such as a duly issued search warrant, subpoena or court order.

Access to Other Sites through KIPA

Each game company Sites: You should be aware that when you are on game&game, you will have the opportunity to visit, or link to, other sites associated with KIPA. These sites are identified as our "Partner Sites". These sites are not owned or operated by KIPA, but are part of a larger network of sites with which the game&game share content and advertising opportunities. We do not share your Personal Information with these Partner Sites.
Linking to Other Sites: You may also visit independent web sites, not owned or operated by KIPA, through links on the Game&game. Such sites are operated by external, third-party service providers. Some of these sites will have their own separate membership processes and privacy policies. We do not control sites that are operated by others and are not responsible for the information practices of these sites. Other sites may set their own cookies, collect data or solicit personal information. It is always a good idea to check the privacy policy and terms of use of any site before offering any of your Personal Information. Information Storage and Security
Your Personal Information is stored on KIPA computer servers (or those of its service providers) located in the United States. We protect your Personal Information with technical, administrative and physical safeguards to protect against loss, unauthorized access, destruction, misuse, modification and improper disclosure. No computer system or information can ever be fully protected against every possible hazard. But KIPA is committed to providing reasonable and appropriate security controls to protect our game&game.com and all Personal Information against foreseeable hazards. Notwithstanding these security measures, please be aware that when you submit Personal Information to the game&game over the Internet, the information may travel over many systems that are not under the KIPA's control. We take the protection of user data very seriously and to that end take reasonable safeguards to prevent interception of any Personal Information. In the case of shopping pages, for example, the credit card information you submit is protected by secure servers.

1. Acceptance of Agreement

2. About Our Services

A). KIPA Sites and Services. As a commitment to our users, we currently provide you with access to a rich collection of online resources. These include various communication tools, online forums, personalized content and branded programming through KIPA Sites and Services. Some Services offered on KIPA are presently provided free of charge. It is possible that this could change in the future.

B). Service Limitations. We will do our best to make your experience with the gamengame.com sites and services a pleasurable one. However, we cannot always foresee or anticipate technical or other difficulties. These difficulties may result in loss of data, personalization settings or other service interruptions. For this reason, you agree that KIPA Sites and Services, including the services of our third-party service providers, are provided "AS IS." You agree that KIPA will not be liable to you or any third party for any modification or discontinuance of these Sites and Services. D). Privacy Policy. KIPA respects your privacy and has developed a detailed Privacy Policy that is incorporated into this Agreement. Please take the time to read our Privacy Policy. By agreeing to this Agreement, you are also accepting the terms of our Privacy Policy.

3. "Rules of the Road"

For the benefit of the entire KIPA community, and to comply with applicable laws, we have a few mandatory guidelines that we call "Rules of the Road." We hope you will find them reasonable. Please understand, though, that any conduct that is judged by KIPA, in its sole and unfettered discretion, to violate the Rules of the Road is grounds for immediate termination of your account. For this reason, we ask that you carefully read and follow them.

A). Provide Accurate Information. You agree to provide true, accurate, current and complete information about yourself as requested in KIPA Sites and Services registration forms (we call this information "Registration Data"). Accurate records help us create better sites and provide us with opportunities to identify new services or products that may interest you. Please update the Registration Data to keep it current and accurate.

B). Guard Your Password. Upon completing the registration process, you will receive an account and select a password. You are responsible for maintaining the confidentiality of your password and account, and you are fully responsible for all activities that occur under your password or account. Notify KIPA immediately of any unauthorized use of your password or account or any other breach of security. You must promptly change your password and notify KIPA of the problem. D). Content Restrictions. KIPA Sites and Services attempt to provide some of the very best content available on the web and make it available to you on the Web for your personal, non-commercial use. All Web site design, text, graphics, the selection and arrangement thereof, and all software that are part of KIPA Sites and Services are protected by international copyright and Trademark laws. The publication, sale, or redistribution in any form or medium of text, photos, graphics, audio and/or video materials or any other form of proprietary content found on KIPA Sites and Services is strictly prohibited without the prior written permission of KIPA Content that is publicly available on KIPA Sites and Service may not be stored in a computer, except for personal and non-commercial use.

E). Limits on Uses of User Information. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Sites or Services. You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Sites or Services or with any other person's use of the Sites or Services. You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message transmittal you send to KIPA on or through the Sites and Services. You may not pretend that you are, or that you represent, someone else, or impersonate any other individual or entity.

4. Rights You Grant to the KIPA Site (gamengame.com)

A). Distributing Content You Produce. Subject to KIPA Privacy Policy, you are licensing to the KIPA Sites and Services any "content" you provide through or to KIPA Sites and Services. User submitted content includes but is not limited to: letters or emails; cheat codes; board posts; reader reviews; game ratings, data, notes and testimonials; and poll votes. KIPA Sites and Services may modify, display, distribute and create new material using such content on KIPA Sites and Services for the promotion and marketing of our services and the operation of our system. By submitting content, you automatically agree, or promise that the owner of such content has expressly agreed that, without any particular time limit, and without the payment of any fees, KIPA Sites and Services and anyone they permit may reproduce, display, distribute and create new works of authorship based on and including the content. You may not submit materials that have been trademarked or copyrighted by anyone other than yourself.

B). Account Access. In order to ensure that the KIPA Sites and Services are able to provide high-quality services that are responsive to our members' needs, you agree that KIPA employees have access to your account and records as reasonably needed to investigate complaints.

C). Merger or Acquisition. In order to ensure a smooth transition of services relative to your subscription, in the event of a merger, acquisition, reorganization, sale of all or substantially all of its assets, or the sale of an individual website owned by KIPA, KIPA may transfer your Personally Identifiable Information and transition your existing accounts to a similar subscription product to a third party as a part of such merger, acquisition, reorganization, or sale.

5. Other Legal Stuff

A). No Endorsement of User Content. You acknowledge and agree that KIPA Sites and Services do not endorse the content of any user and are not responsible or liable for any content, even though it may be unlawful, harassing, libelous, privacy invading, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable, or that it infringes or may infringe the intellectual property or other rights of another. You acknowledge that KIPA Sites and Services do not pre-screen any user posted content, but that KIPA and their designees will have the right (but not the obligation) in their sole discretion to refuse, edit, move or remove any content that is publicly available via the Sites and Service. User is defined as any person who visits KIPA Sites and receives information or uses KIPA Services.

B). Limitation of Liability. You agree that the KIPA will not be liable to you for any harms, which lawyers and courts often call direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if the KIPA Sites have been advised of the possibility of such damages), resulting from: (i) The use or the inability to use the service; (ii) The cost of getting substitute goods and services resulting from any products, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) Unauthorized access to or alteration of your transmissions or data; (iv) Statements or conduct of anyone on the service

C). Copyright Infringement. KIPA respects the intellectual property of others, and we ask our users to do the same. KIPA may, in appropriate circumstances and at its discretion, disable and/or terminate the accounts of users who may be infringing the intellectual property rights of others. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide KIPA's Copyright Agent the following information:

1. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
2. a description of the copyrighted work or other intellectual property that you claim has been infringed;
3. a description of where the material that you claim is infringing is located on the site;
4. your address, telephone number, and email address;
5. a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law; and
6. a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.

D) More Stuff.
The KIPA Sites and Services provide information of a general nature and are designed for informational and entertainment purposes only and are not meant to be a substitute for medical, health, legal, or financial advice from a professional. Consult with your professional for any specific medical, health, legal, or financial concern. The KIPA Sites and Services do not endorse any of the treatments, medications, or products discussed herein.
KIPA rights under this Agreement may not be waived unless KIPA agrees to such change in writing. This Agreement is personal to you and you may assign this agreement only with KIPA prior written approval. Any other attempt to assign, transfer or delegate this Agreement shall be null and void.
